GELIN WARRANTY TERMS

This Limited Warranty applies to all jewelry products ("Products") purchased from GELIN LLC ("GELIN", "we", "us", or "our") through gelindiamond.com, our authorized retail channels, or our marketplace storefronts Amazon and Etsy. By purchasing a Product from GELIN, you ("Customer", "you") agree to the terms of this Limited Warranty.

1. Warranty Coverage

1.1 Manufacturing Defect Warranty

GELIN warrants that each Product is free from defects in materials and workmanship for a period of two (2) years from the date of original purchase ("Warranty Period"), provided the Customer registers the Product within thirty (30) days of purchase at gelindiamond.com/warranty-registration.

For unregistered Products, the standard manufacturer warranty period of ninety (90) days from purchase applies.

1.2 What This Warranty Covers

During the Warranty Period, GELIN will, at its sole discretion, repair, replace, or refund in whole or in part Products that exhibit:

Manufacturing defects in materials or workmanship, including faulty soldering, defective settings, or improperly secured components;
Failure of chains, clasps, or closures under normal wear and use;
Loss of accent diamonds, defined as stones weighing 0.10 carat or less, due to defective settings under normal wear and use, subject to the limitations in Section 2;
Free return shipping for all warranty-covered repairs within the United States.

1.3 Diamond Replacement Coverage

GELIN provides free replacement of accent diamonds, defined as stones weighing 0.10 carat or less, lost due to defective settings under normal wear and use, subject to the following conditions:

The Customer must report the loss within fourteen (14) days of discovering it;
The Customer must return the Product to GELIN for inspection;
The replacement is limited to one (1) claim per Product per 12-month period;
Center stones, focal stones, or stones exceeding 0.10 carat are not covered under this warranty and must be insured separately by the Customer;
GELIN reserves the right to determine, in its sole discretion, whether the loss is due to defective setting or other causes excluded by this warranty.

2. Exclusions

This Limited Warranty does not cover the following:

Normal wear and tear, including but not limited to surface scratches, dents, loss of finish, fading, or patina;
Damage caused by accident, impact, abuse, misuse, or neglect, including but not limited to damage from drops, crushing, or contact with hard surfaces;
Damage caused by exposure to chemicals, including but not limited to chlorine, bleach, household cleaners, perfumes, lotions, hairspray, or sunscreen;
Damage caused by exposure to extreme heat, cold, moisture, or saltwater;
Loss or theft of the Product or any component thereof, except as expressly provided in Section 1.3;
Damage resulting from alterations, modifications, repairs, resizing, or service performed by anyone other than GELIN or a GELIN-authorized service provider;
Center stones, focal stones, or any stone exceeding 0.10 carat in weight;
Damage caused by use in activities such as sports, manual labor, swimming, exercising, gardening, or sleeping;
Cosmetic discoloration of plated finishes. GELIN's solid gold pieces are not subject to this exclusion;
Pearls, opals, turquoise, and other organic or soft gemstones, which require specialized care;
Products purchased from unauthorized resellers, third-party marketplaces other than our authorized Amazon and Etsy storefronts, or secondhand;
Damage occurring during shipping when the Customer is responsible for shipping, such as returning a Product for repair without using a GELIN-provided shipping label;
Any damage discovered more than seven (7) days after delivery that is not documented and reported within that period for damage claimed to have occurred during initial shipping.

3. Warranty Process

3.1 How to Submit a Warranty Claim

To submit a warranty claim:

Email contact@gelindiamond.com with your order number, certificate number, a description of the issue, and clear photographs of the Product;
GELIN will respond within five (5) business days with instructions and, if approved, a prepaid shipping label;
The Customer must securely package the Product following our shipping guidelines;
Upon receipt, GELIN will inspect the Product within ten (10) business days and notify the Customer of the determination.

3.2 GELIN's Remedies

If a valid warranty claim is approved, GELIN will, at its sole discretion:

Repair the Product at no cost to the Customer;
Replace the Product with an identical or comparable item if repair is not feasible;
Issue a refund of the original purchase price, excluding shipping, taxes, and customization fees, if neither repair nor replacement is feasible.

The remedy chosen by GELIN is the exclusive remedy available to the Customer under this Limited Warranty.

3.3 Estimated Turnaround

Standard warranty repairs are completed within fifteen (15) business days from GELIN's receipt of the Product. Complex repairs requiring international shipment to our manufacturing partners may take up to forty-five (45) days. GELIN does not guarantee specific completion dates.

4. Limitation of Liability

4.1 Disclaimer of Implied Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GELIN DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ANY IMPLIED WARRANTY THAT CANNOT BE DISCLAIMED IS LIMITED IN DURATION TO THE WARRANTY PERIOD.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

4.2 Exclusion of Consequential Damages

IN NO EVENT SHALL GELIN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, OR DIMINUTION OF VALUE, ARISING OUT OF OR RELATING TO THE PRODUCT OR THIS LIMITED WARRANTY, EVEN IF GELIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

4.3 Maximum Liability

GELIN'S TOTAL LIABILITY UNDER THIS LIMITED WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID BY THE CUSTOMER FOR THE PRODUCT.

5. Transferability

This Limited Warranty is non-transferable and applies only to the original purchaser of the Product. If the Product is gifted, the original purchaser remains the warranty holder. The Product's certificate number and order number must match GELIN's records.

6. Governing Law and Dispute Resolution

6.1 Governing Law

This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

6.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to this Limited Warranty or the Product shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Broward County, Florida.

6.3 Class Action Waiver

THE CUSTOMER AND GELIN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

6.4 Right to Opt Out of Arbitration

The Customer may opt out of the binding arbitration provision by sending written notice to contact@gelindiamond.com within thirty (30) days of the original purchase date. The notice must include the Customer's name, order number, and a clear statement that the Customer wishes to opt out of arbitration.

7. Your Rights Under State Law

This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

8. Changes to This Warranty

GELIN reserves the right to modify this Limited Warranty at any time. Modifications will not retroactively affect warranty rights for Products already purchased.
